Convention on Human Rights and Biomedicine of the Council of Europe

Article 11 of the “Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine: Convention on Human Rights and Biomedicine”, which was adopted by the Committee of Ministers of the Council of Europe and has not yet been signed by Germany, stipulates that “any form of discrimination against a person on grounds of his or her genetic heritage” is prohibited. Article 13 authorises interventions on the human genome for diagnostic purposes, provided they do not involve any modification of the genome. Article 14 prohibits sex selection, but allows it – with reference to national laws and directives – where serious hereditary sex-related disease is to be avoided; however, no specifications are made regarding the method to be employed (using germ cells prior to fertilisation or embryonic cells as part of PGD). Neither PGD nor prenatal diagnosis (PND) are explicitly regulated in the framework convention.
